GENERAL TERMS AND CONDITIONS

The Service Provider

The online store hellasolive.com (hereinafter: the “Webshop”) is operated by Agrologica Kft. (hereinafter: the “Service Provider”).

• Company name: Agrologica Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság
• Short company name: Agrologica Kft.
• Registered office: 1088 Budapest, Puskin 15. II.10 / B
• Postal address: 1088 Budapest, Puskin 15. II.10 / B

Use of the Service

Orders can be placed in the Webshop only via the internet, online. The Service Provider does not accept orders placed by telephone, fax, e-mail, or post.

Information related to orders will also be sent to Buyers electronically.

After placing the product(s) in the cart, the Buyer must select a delivery method and payment method.

By pressing the “Submit Order” button, the Buyer makes an offer that creates a payment obligation, and an automatic confirmation will be sent within four business days of the order.

The confirmation always includes:

  • the selected delivery and payment method

  • the value of the order

  • shipping conditions

  • product name and quantity

  • the Buyer’s data

If the confirmation containing the conditions of the order is not received, the consumer is released from the obligation of the offer.

Before submitting the order, the Buyer has the opportunity to modify the data provided during registration by overwriting and saving the updated information.

The language of the contract is Hungarian.

The order qualifies as an electronically concluded but unsigned contract, the contents of which are recorded and archived, and can later be accessed and retrieved.

The registration number of the contract is the order identification number.

Prices displayed in the Webshop are in Hungarian Forints (HUF) and include VAT.

The Service Provider makes every effort to deliver the products ordered by the Buyer within the deadline specified in the order.

If this is not possible for any reason, the Service Provider will immediately inform the Buyer and refund any prepaid amount as soon as possible, but no later than within 14 days following the notification.

The Buyer will not incur any additional costs related to the refund.

The Service Provider strives to maintain the accuracy of the information displayed on the website and keep stock information up to date. However, due to the activities of the Service Provider’s commercial partners (third parties), the performance of the contract may become impossible at the moment of contract formation for reasons unforeseeable by the Service Provider. Such impossibility does not render the Service Provider’s offer misleading, as the Service Provider acted to the best of its knowledge regarding product availability when making the offer.

Right of Withdrawal

According to Government Decree 45/2014 (II.26.), the Buyer may withdraw from the purchase without justification within 14 days from the receipt of the product.

The Buyer may exercise the right of withdrawal by making a clear statement:

  • by telephone: +36 30 640 438

  • by e-mail: info@gyapjumulcs.hu

  • or by using the model withdrawal form provided in Annex 2 of Government Decree 45/2014 (II.26.)

In case of written withdrawal, it is sufficient to send the withdrawal statement within 14 days of receipt of the product.

The Buyer may also exercise the right of withdrawal between the date of conclusion of the contract and the date of receipt of the product.

In the case of home delivery, the date of receipt is the time when the package is taken over from the courier. This can be proven with the delivery receipt or invoice issued at the pickup point or the receipt provided by the courier.

Personal pickup does not exclude the right of withdrawal.

In case of withdrawal, the Buyer must return the product to the Service Provider at their own expense. The Service Provider will refund the purchase price of the returned product(s) and any other costs without delay but no later than within 14 days after receiving the returned product(s).

The delivery cost is refunded only if the entire order is cancelled.

In case of withdrawal, the Buyer bears only the cost of returning the product.

The purchase price and delivery cost will only be refunded after the product has been returned or the Buyer has provided proof of sending it back within 14 days from notifying the withdrawal — whichever occurs first.

Refunds will be made using the same payment method used for the original transaction, unless the Buyer explicitly agrees to another method. The Buyer will not incur additional costs due to a different refund method.

We cannot accept parcels returned with cash-on-delivery (COD).

The Buyer cannot exercise the right of withdrawal in the cases specified in Section 29 of Government Decree 45/2014, in particular for:

  • products not pre-manufactured that were produced based on the consumer’s instructions or customized for the consumer

  • perishable products or products with a short shelf life

  • sealed products that cannot be returned after opening for health or hygiene reasons

  • products that after delivery are inseparably mixed with other products

  • sealed audio/video recordings or software if opened after delivery

  • newspapers, magazines, or periodicals (except subscription contracts)

  • digital content not supplied on a tangible medium, if performance has begun with the consumer’s prior consent and acknowledgment that they lose the right of withdrawal

The Service Provider may claim compensation for damages resulting from improper use of the goods.

If the Buyer concluded a service contract, the Buyer may terminate instead of withdraw within 14 days from the date of contract conclusion.

The termination right cannot be exercised after the service has been fully performed, if the Service Provider began performance with the consumer’s prior consent and the consumer acknowledged that they would lose their right of termination once the service is completed.

Warranty and Product Liability

If the ordered product is defective, the Buyer may assert warranty claims against the Service Provider according to Act V of 2013 on the Civil Code.

The Buyer may request:

  • repair, or

  • replacement

unless these are impossible or would cause disproportionate additional costs to the Service Provider.

If the Buyer does not request repair or replacement, they may request a proportionate price reduction, repair the defect at the Service Provider’s expense, or withdraw from the contract.

Withdrawal is not permitted for insignificant defects.

The Buyer must report the defect without delay, but no later than within 2 months after discovering it.

Warranty claims cannot be enforced after 2 years from the date of performance.

Within 6 months of delivery, the defect is presumed to have existed at the time of delivery unless proven otherwise.

After 6 months, the Buyer must prove that the defect already existed at the time of delivery.

Product Warranty

Instead of asserting a warranty claim against the Service Provider, the Buyer may assert a product warranty claim against the manufacturer or distributor.

In this case the Buyer may only request repair or replacement.

A product is defective if it does not meet quality requirements in force at the time of marketing or does not have the characteristics described by the manufacturer.

The Buyer must prove the defect.

Product warranty claims can be enforced within 2 years from placing the product on the market.

Guarantee

For durable consumer goods listed in Government Decree 151/2003 (IX.22.), the Buyer may enforce a 1-year guarantee.

The Service Provider is exempt only if it proves that the defect arose after delivery.

If a defect prevents proper use and is reported within 3 working days, the product will be replaced (if available in stock).

The Service Provider strives to complete repair or replacement within 15 days.

Guarantee rights do not exclude other statutory rights.

Accuracy of Information

The Service Provider makes every effort to ensure the accuracy of product data (price, availability, description).

Clearly erroneous prices resulting from system errors (e.g., 0 or 1 HUF) do not constitute an offer.

Images displayed are illustrations; product characteristics are specified in the product description.

Liability for possible errors is governed by Government Decree 45/2014 and the Civil Code.

Additional conditions for using the services are available on the homepage of the webshop.

Age Restriction

According to Hungarian law, it is prohibited to sell alcohol or sexually explicit products to persons under 18.

Before placing an order, the Buyer must declare that they are over 18 years old.
